Consular Services

Both the Embassy in Abu Dhabi and the Consulate in Dubai provide a number of consular services to the South African community in the UAE and Qatar, as well as foreign nationals resident in the UAE who would like to visit South Africa.
Requirements for visas to travel to South Africa

Business Visit

  • Completed visa application form + 1 passport size photograph.
  • Original passport + copy of all relevant pages of the applicants passport.( If applicant currently residing permanently in the GCC, a copy of the relevant residence permit to be included
  • Letter from employer stating that the applicant has a long term work contract and will returning to their employment. ( applicable to non GCC nationals only). GCC Nationals to state in writing which organization or company they represent
  • Letter from the employer stating that he will pay for accommodation costs in South Africa. (Applicable to non GCC nationals only)
  • Detailed letter of invitation from a South African company inviting the applicant to do business in South Africa. ( Applicable to all )
  • An itinerary, i.e. Hotel where the applicant will be staying. ( Applicable to all)
  • Copy of ticket with confirmed return date. ( Please note: NO open ticket).
  • Visa fees are subject to change and applicants should check with the Embassy when they apply.
APPLICATIONS SUBMITTED BY MAIL - Applicants who are not able to submit their applications in persons at the Embassy are advised to utilize courier services and arrange for the prepaid re-delivery of their passports. The applicant is required to covers all expenses in respect of the return of a passport as this expense is not covered by the Embassy.

Tourism Visit

  • Competed visa application form + 1 passport size photograph. ( applicable to all)
  • Original passport + copy of all relevant pages of the applicants passport, ( If applicant currently residing permanently in the GCC, a copy of the relevant residence permit to the included )
  • Letter from employer stating that the applicant has a long term work contract and will be returning to their employment. ( applicable to non GCC nationals only). GCC Nationals to state in writing which organization or company they represent.
  • Proof that the applicant has sufficient funds to support his / her accommodation costs in South Africa and return to the country of origin. ( applicable to all)
  • A detailed itinerary and confirmation of hotel bookings. ( applicable to all )
  • Copy of ticket with confirmed return date. ( Please note: NO open ticket). (applicable to all)
  • Visa fees are subject to change and applicants should check with the Embassy when they apply.
  • Applications should be sent to the Embassy either by courier or handed in personally.

Diplomatic, Official and Courtesy Visas

  • These arrangements are not applicable to individuals whose visa exemption have been withdrawn. In all cases the normal entry requirements still have to be complied with before admission is gained.
  • Aliens who intend to temporarily manage or conduct any business in the RSA whether for their own account or not are not regarded as business visitors, but require work permits. Representatives of the media reporting on current events as well s stills producers and their teams who are employed abroad are however permitted to enter the country as business visitors. Sports persons who are passport holders of the countries listed also do not require visas for participating in competitive events, as opposed to those who wish to take up contracts or sports positions in the RSA, who require work permits.
  • The Department of Foreign Affairs should be consulted regarding visas for holders of diplomatic and official passports.
  • Visas are not required by passport holders of Lesotho, Swaziland, Botswana, Namibia, Zambia and Malawi who are entering the RSA as commercial heavy duty vehicle drivers provided their visits do not exceed 15 days and on condition that they can produce a letter confirming their employment with a transport company on entry.
  • Staff members of the Southern African Development Community (SADC) who travel on SADC laissez passers are exempt from South African visa control for bona fide official business visits of up to 30 days and transits.
  • Holders of United Nations laissez passer are exempt from visa control when visiting the RSA for periods not exceeding 30 days for bona fide holiday and official business purposes and transits and when accredited in the RSA, for the duration of their accreditation.
  • Volunteers attached to United Nations agencies and traveling on ordinary passports are exempt from the visa requirement, provided that they are in possession of the necessary letters or identification documents to identify themselves at ports of entry as personnel of UN agency.
  • Holders of OAU lazes passer are exempt from visa control when visiting the RSA for bona fide official business visits of up to 30 days and transits.
  • UN employees who are permanent residents in the RSA are exempt from the re-entry visa requirement, provided that they are in possession of the necessary letters or identification documents to identify themselves at ports of entry as personnel of UN agency.
  • visas are not issued at South African ports of entry and airline officials are obliged to insist on visas, if required, before allowing passengers to board.
  • South African's re-admission to international organizations for example the Commonwealth in no way affects the RSA's visa policy, which is purely a bilateral matter. Citizens of countries which are also members of such organizations and which are not listed above are not exempt from the visa requirement.
  • International volunteers attending holiday camps or community sports development projects and post-doctoral research fellows conducting research do not require work permits but must apply for visitor's visas.

Work Permit requirements

  • 1 Passport size photo
  • Fully completed and signed application for a temporary residence permit
  • Passport valid for no less than 30 days after the expiry of intended visit
  • Payment of the prescribed fee
  • A vaccination certificate, if required by the Act
  • Proof of financial means in the form of:
    • Bank statements
    • Salary advices
    • Undertaking (s) by the host (s) in the Republic
    • Bursaries
    • Medical cover
    • Cash available, including credit cards or travelers’ cheque to cover envisaged living expenses during the sojourn in the Republic
  • Applicants traveling by air must be in possession of a return or onward ticket or proof of sufficient funds, or lodge a cash deposit of equivalent value to such a ticket
  • Statement and/or documentation confirming purpose and duration of visit
  • Birth certificate
  • Marriages certificate, where applicable
  • Divorce decree, where applicable
  • Proof of custody, where applicable
  • Death certificate, in respect of late spouse, where applicable
  • Proof of legal separation, where applicable
  • Police clearance certificates in respect of all applicants 21 years or older, in respect of all countries where person(s) resided one year or longer, to be submitted within twelve months of the application if not immediately available
  • Proof of availability of funds for transfer from abroad
  • Undertaking to register with the appropriate statutory body, if required by the nature of the business
  • Certification by a Chartered Accountant which confirms that at least two of the following requirements have been met of which one must be the capital to be invested
    • At least R2 500 000-00 value invested as part of the book value of the business
    • Business track record to prove entrepreneurial skill
    • Proof that the business contributes to the geographical spread of economic activity
    • Proof that at least 5 South African citizens or residents will be employed
    • The export potential of the business; or
    • Calls for or involves a transfer of technology not previously generally available in South Africa
  • Documentation proving the investment, such as shareholders’ or partnership agreements (when investing into an existing business)
  • Details of partners/directors (when investing in existing business)

CONDITIONS

  • If the business no longer maintains the capitalization requirement, the permit may be withdrawn
  • A holder of the business permit may conduct work only when it is related to the relevant business activities
  • Must register with the South African Revenue Services (SARS) upon entry

Study Permit Requirements

Documentation:

  • Passport valid for no less than 30 days after the expiry of intended visit
  • Payment of the prescribed fee, if applicable
  • A vaccination certificate if required under the Act (yellow fever endemic areas)
  • Proof of financial means in the form of
    • - bank statements (last 6 months)
    • - salary advices
    • - undertaking(s) by the host(s) in the Republic
    • - bursaries
    • - medical cover, or
    • - cash available, including credit cards or traveller’s cheques
    • - (to cover envisaged living expenses during the sojourn in the Republic)
  • Applicants traveling by air must be in possession of a return r onward ticket or proof of sufficient funds, or lodge a cash deposit of equivalent value to such a ticket
  • Statement and/or documentation confirming purpose and duration of visit
  • An official letter of provisional enrolment / acceptance from the institution of learning concerned
  • Details regarding arranged accommodation, if any
  • Proof of sufficient funds to cover tuition fees, maintenance and incidental costs
  • In the case of a minor, the particulars of the person in the Republic who will act as the learner’s guardian and confirmatory letter from such person, and proof of consent for the intended stay from both parents, or from the sole custody parent along with proof of sole custody
  • An outline of the course or academic program for which the applicant has been accepted and proof of the required qualifications to attend, if any
  • A police clearance certificate if required in respect of all applicants of 23 years of age or older, in respect of all previous countries of residence for periods exceeding one year, to be submitted within twelve months of the application if not immediately available
  • Full medical certificate
  • Copy of birth certificate
  • Full marriage certificate (where applicable)
  • Divorce decree (where applicable)
  • Death certificate of late spouse, where applicable
  • Proof of legal adoption (where applicable)
  • Legal separation order (where applicable)
  • Undertaking by Institution to keep the Department informed if learner discontinues the course or fails to qualify for re-enrolment
  • Completed and signed application form (BI-1738)
  • One passport photo

Conditions:

  • The applicant must provide periodic reports of satisfactory performance in his or her studies by means of his or her letter, which reports, unless otherwise determined by the Department under the circumstances, shall be due every six months.
  • The permit fee is automatically forfeited if the application is not approved.
  • Persons wishing to study under three months may be issued with a visitor’s permit (endorse visa appropriately)

ONLY AFTER ALL THESE REQUIREMENTS ( ACADEMIC AS WELL AS RESIDENTIAL HAVE BEEN COMPLIED WITH AND THE STUDENT ISSUED WITH THE NECESSARY ENTRY AUTHORIZATION ( STUDY permit), MAY SUCH A STUDENT PROCEED TO SOUTH AFRICA.

Immigration to South Africa

In order for one to immigrate and live in South Africa, a person must obtainpermanent residence.
All applications for permanent residence are considered on merit by an autonomous statutory body,
the Immigrants Selection Board.

Applications for permanent residence MUST be lodged from current country of residence or
the closest South African mission.

Immigration Generally

1.1 The Republic of South Africa can accommodate only a certain number of
immigrants. There are valid reasons for this. In the first instance South Africa has a
vast reserve of unskilled and semi-skilled workers who are entitled to employment
opportunities and to an economically viable lifestyle for themselves and their families.
For this reason no one in the unskilled and semi-skilled categories will normally be
accepted as an immigrant worker in South Africa.

1.2 Because of the considerable need for the creation of job opportunities for South
African workers, as well as for their training and development, it will be understood
and appreciated that the RSA cannot afford to grant permits for permanent residence
to persons who are not seriously committed to immigrating to the country and to
investing their assets, skills, knowledge and experience for the benefit of themselves
and the people of South Africa. Once a permit for permanent residence has been
granted, permanent residence must be taken up within six months and if any
extension of this period is applied for, due cognizance will be taken of the reasons for
such request and of any assets already transferred to and productively invested in
South Africa.

Basic Principles and Policies on Immigration

2.1 The present immigration policy places emphasis on the broadening of the
economic base of South Africa by concentrating especially on the obtaining of those
immigrants who are in a position to render a meaningful contribution in this regard.

2.2 The South African immigration policy is embodied in Act 96 of 1991, which
prescribes certain requirements which are to be met by an applicant who wishes to
immigrate permanently to South Africa. The requirements are:

the applicant must be of good character;
he/she must be a desirable inhabitant;
he/she must not be likely to be harmful to the welfare of the Republic of South
Africa; and,
most important; he/she must not follow an occupation in which there is
already a sufficient number of persons available to meet the requirements of
the country.

2.3 These requirements are aimed at individual selection and all applications for
permanent residence are considered on merit by an autonomous statutory body, the
Immigrants Selection Board.

2.4 In particular cognizance should be taken of the legal provision which places an
obligation on the Board to ensure that only those applications are approved where the
applicants will follow occupations for which a proven demand exists in the RSA.

2.5 This provision brings about that a policy of individual selection is being applied.
The overriding consideration should always be the protection of the inherent rights of
South African citizens or permanent residents to employment opportunities which
may exist in the country.

2.6 The ongoing unfavorable position in South Africa as regards large-scale
unemployment and a downturn in the economy, together with an increasing demand
for socio-economic services and facilities make it all the more essential that a policy
of careful selection with due regard to the existing stringent requirements should be
pursued.

Categories of Immigration/Immigration Procedure by Each Category

In terms of the various sub-sections of section 25 of the Act, persons qualifying for
immigration permits may be divided into the following groupings:

3.1 Persons following an occupation either in the employment of someone else or
self-employed. Such persons are divided into the following categories viz.:

Workers; and self-employed persons

3.2 Persons who will not be following an occupation, but are desirable in that they
will contribute to the economy and welfare of the Republic. Such persons are divided
into two (2) categories, viz.:

Financially independent persons;
and retired persons.

3.3 Spouses and dependent children of persons residing permanently and lawfully in
the Republic.

3.4 Destitute, aged or infirm persons who are financially unable to sustain
themselves and have immediate members of families lawfully and permanently
resident in the Republic, with the means to maintain such members and who will not
be following an occupation. Such persons are categorized as:

Sponsored persons.

3.5 Lastly, economically active persons who are unable to submit permanent offers
of employment, and are financially assisted by parents, brothers/sisters who are
South African citizens or permanent residents:

Family reunion scheme.

Rights and Responsibilities of Approved Immigrants

An immigration permit holder is not automatically a South African citizen but may
apply for naturalization after a period of five (5) years continuous residence. A
permanent resident may not qualify for a permanent position in State service, as
South African citizenship is a pre-requisite for such posts. A permanent resident:

does not have an automotive right to vote in elections; he/she is not entitled to a
South African passport; and may lose the right to permanent residence after being
absent from the Republic for a continuous period of five (5) years. Under certain
circumstances a permanent resident may be liable to deportation.

With regard to responsibilities, permanent residents are expected to be faithful to and
law-abiding inhabitants of the Republic and respect the rights of others as contained
in South Africa's Bill of Rights.

Fees payable are adjusted on an annual basis. For further

PERMANENT RESIDENCE PERMIT (DIRECT RESIDENCE)

  • Has been the holder of a work permit, including one issued under a corporate permit for 5 years and has received an offer for permanent employment

DOCUMENTATION REQUIRED

  • Proof of 5 years continuous work permit status
  • Proof of offer of permanent employment
  • Certification from his/her prospective permanent employer’s chartered accountant of the job description and that the position exists and is intended to be filled by the applicant
  • Letter of approval from the relevant organ of state
  • Proof of registration with the professional body, board or council in the Republic, where applicable.
  • Certification by the department of labour that the terms and conditions of such offer, including salary and benefits, are not inferior to those prevailing in the relevant market segment for citizens and residents, taking into account applicable collective bargaining agreements and other standards.

  • Death Certificate of late spouse (if applicable)
  • Police clearance certificates in respect of all applicants 21 years of age and older in respect of all countries where such persons resided for a period of one year or longer
  • Valid temporary residence permit, if the applicant is already in the RSA
  • Highest educational, trade and /or professional certificates
  • Work references or certificates of service (covering at least the last 5 years)
  • Payment of the prescribed fee
  • The applicant is spouse of a South African citizen or permanent resident provided that a good faith spousal relationship exists

DOCUMENTATION REQUIRED

  • Identity document / permanent residence permit in respect of the South African Spouse
  • Declaration of support from the spouse who is the citizen / resident
  • Proof in the form of communal accounts or other documents reflecting cohabitation (where applicable)
  • If the foreign spouse is a refugee, he / she must submit an affidavit with regard to all aliases used

  • Unabridged Birth Certificate (If applicant is refugee can submit sworn affidavit in respect of country fled from)

  • Proof of custody / maintenance (where applicable)
  • Consent from parents of minor children (where applicable)

  • Death Certificate of late spouse
  • Police clearance certificates in respect of all applicants 21 years of age and older in respect of all countries where such persons resided for a period of one year or longer (If applicant is refugee can submit sworn affidavit in respect of country fled from)
  • Valid temporary residence permit, if the applicant is already in the RSA

CONDITIONS
Such permit is issued on condition that it shall lapse if at any time within three years from its application the good faith spousal relationship no longer subsists i.e. the applicant and the South African spouse have to arrange for an interview after three years to satisfy the department, that the spousal relationship still subsists.

  • The applicant is a child of a citizen or resident under the age of 21

CONDITIONS
The permit shall lapse if the child and / or his / her parents do not submit an application for confirmation of permanent residence status within 2 years of his or her having turned 21 years of age

  • The applicant is a child of a citizen above the age of 21 years

PERMANENT RESIDENCE PERMIT (RESIDENCE ON OTHER GROUNDS)

The department may issue a permanent residence permit to a foreigner of good and sound character who

A) Has received an offer for permanent employment

  • Highest educational, trade and / or professional certificates
  • Work references or certificates of service (covering at least the last 5 years)

  • Offer of permanent employment
  • Certification from a chartered accountant acting on behalf of applicants prospective permanent employer that the position exists and that the position and related job description was advertised in the prescribed form and no suitably qualified citizen or resident was available to fill it
  • Certification from the Department of Labour that the terms and conditions of such offer, including salary and benefits, are not inferior to those prevailing in the relevant market segment for citizens or residents, taking into account applicable collective bargaining agreements and other standards
  • Confirmation that he application falls within the yearly limits of available permits prescribed from time to time for each sector of industry, trade and commerce after consultation with the Departments of Trade and Industry, Labour and Education
  • Payment of prescribed fee

CONDITIONS

  • The holder shall remain employed in the field in respect of which the offer of employment was made, for a period of at least 2 years or alternatively a condition determined by e.g. the Department of Health

B) The applicant has demonstrated to the Department’s satisfaction, his/her possessing extraordinary skills or qualifications

C) Applicant intends to establish a business in the republic of South Africa or
Already holds a business permit to conduct a business in South Africa or
Intends to invest in an existing business in South Africa, all three of which must invest,
or have already invested the prescribed financial contribution, which shall be part,
or is part of the (intended) book value of the business

    • · Proof of at least 5 citizens / residents shall be employed
    • · The export potential of the business
    • · Calls for or involves a transfer of technology not previously generally available in the Republic

ii) Business has already been established and is being conducted

  • Valid temporary residence permit, if the applicant is already in the Republic of South Africa
  • Payment of prescribed fee
  • Certification from the applicant’s chartered accountant that the requirements as set out below were met when the business was established:
  • Proof of availability of funds for transfer from abroad
  • Undertaking to register with the appropriate statutory body, if required by the nature of the business
  • Certification of a chartered accountant that applicant invested at least R2 500 000 as part of the book value of the business and meet one of the following criteria
  • Business track record to prove entrepreneurial skills
  • Proof that business contributes to the geographical spread of economic activity
  • Proof of at least 5 citizens / residents shall be employed
  • The export potential of the business
  • Calls for or involves a transfer of technology not previously generally available in the Republic
  • Proof of valid temporary residence
  • Proof of a valid business permit
  • Proof of registration with the South African Revenue Service
  • Proof of registration with the appropriate statutory body, if any

    iii) Existing business is to be invested into

  • Certification of a chartered accountant that applicant invested at least R2 500 000 as part of the book value of the business and meet one of the following criteria

  • The export potential of the business
  • Calls for or involves a transfer of technology not previously generally available in the Republic

  • Documentation proving the investment, such as shareholder or partnership agreements
  • Details of partners or directors
  • Proof of valid temporary residence, if applying in South Africa

CONDITIONS

  • The applicant has to renew the certification of the chartered accountant two years after permanent residence status has been granted, and again three years later. Failure to do so, shall result in the permanent residence permit lapsing

D) A refugee

  • Police clearance certificates in respect of all applicants 21 years of age and older in respect of all countries where such persons resided for a period of one year or longer
  • Valid temporary residence permit, if the applicant is already in the Republic of South Africa
  • An affidavit with regard to all aliases used
  • Proof of 5 years continuous residence as a refugee
  • A certification by the Standing Committee for Refugee affairs stating whether the applicant will remain a refugee indefinitely or not

E) Applicant intends to retire in the Republic of South Africa (no specific age limit)

  • Valid temporary residence permit, if the applicant is already in the Republic of South Africa
  • Payment of prescribed fee
  • Certification by a chartered accountant that the applicant receives a pension with a minimum value of R25 000 per month; or
  • has a irrevocable retirement annuity / retirement account to the equivalent amount; or
  • has a net worth of not less than R15 000 000, providing an income of at least R25 000 per month.

CONDITIONS

  • Should a retired person wish to work, he/she must submit a contract of employment and proof that a South African citizen or resident is not available for the occupation applied for.
F) The applicant has provided a certification by a chartered accountant that he/she has prescribed minimum net worth and has paid a prescribed amount tot eh Department

G) The applicant is a relative of a citizen resident within the first step of kinship (parents, children and spouse)

  • Valid temporary residence permit, if the applicant is already in the Republic of South Africa

  • Proof of first step kinship / relationship
  • Proof of citizen / resident’s annual income except where the foreign relative is the parent of a minor child
  • An undertaking by the citizen / resident with regard to financial, medical and physical responsibility for the applicant, except where the relative is the parent of a minor child
  • In case of a spouse, proof in the form of communal accounts or other documents reflecting cohabitation, where applicable


CONDITIONS

  • If permanent residence status has been obtained on the basis of being a parent of a minor South African citizen / resident, the permit shall lapse upon the child becoming 21 years of age
